As the jury trial for a Cambria County man charged in connection with the death of an IUP student in 2017 approaches, a status conference will be held today in Indiana County Court.
Court documents say that 25-year-old Brady DiStefano of Westmont will be before President Judge Thomas Bianco today for the status conference. He is charged with aggravated assault in connection with a fight between him and a fellow IUP fraternity brother Caleb Zweig on February 3rd of 2017. Zweig would later die at Indiana Regional Medical Center. DiStefano was originally charged with criminal homicide as well as aggravated assault, but then-President Judge William Martin dismissed the charges because of insufficient evidence. Superior Court reversed part of the ruling, saying that there was sufficient evidence that would permit a trial on the aggravated assault charge. After that, Martin ruled the jury could not hear evidence that DiStefano’s role in the fight that lead to Zweig’s death, nor could it hear testimony from the forensic pathologist who performed the autopsy. State Superior Court also overruled those rulings.
Jury selection is scheduled to start October 24th.
