The attorney for Ronald Weiss on Friday filed a motion to continue the jury selection and trial of his client for the murder of Barbara Bruzda, a 16-year-old Tunnelton girl who was killed in October of 1978.
Weiss was found guilty of murder in 1997, but the verdict was overturned in 2018 by a federal judge on the grounds of prosecutorial misconduct by a state deputy attorney general and a state trooper. Judge Tom Bianco subsequently ruled that Weiss could be re-tried because the prosecution’s misconduct and Weiss’s guilt or innocence are two separate issues, a decision that was upheld on appeal in State Superior Court.
Jury selection and the trial were scheduled to begin March 21st but attorney Malcolm Taylor Johnson’s filing on Friday would delay the proceedings should Judge Bianco assent.
