A number of defendants are scheduled for sentencing today in Indiana County Court, including the final defendant in the attack on Cody Overdorff last summer on the Hoodlebug Trail in Homer City.
President Judge William Martin will preside over the sentencing of 20-year-old Dakota Patterson, who pleaded guilty to misdemeanor stalking, false imprisonment, and simple assault. Co-defendants Cory Blystone, Jordan Kinney, and Katelyn Lemley have already pleaded guilty and been sentenced. Kinney and Blystone were sentenced for the same offenses as Patterson, and Lemley was sentenced to two counts of conspiracy and a single count of disorderly conduct.
The case led to the passage in the State House of Representative Jim Struzzi’s bill called “Cody’s Law”, which would charge anyone who intentionally causes bodily injury to a person with a physical or intellectual disability with aggravated assault, a second degree felony. The bill is currently awaiting action in the Senate.
Others to be sentenced by Judge Martin today are:
- 44-year-old Tammy Marie Powell of Clymer for accessing a device in a counterfeit, altered, or incomplete manner, in a forgery case.
- 63-year-old Michael Joseph Braden of Cherry Tree, for terroristic threats.
- 40-year-old Justin Pauldean Smith of Marion Center, for criminal trespass in a burglary case.
- 23-year-old Jamal Hughley of Butler, for corruption of minors.
- 34-year-old Kayla Nicole Steele of New Bethlehem, Clarion County, for two counts each of retail theft and corruption of minors, in two separate cases.
- 29-year-old Nicole Marie Windows of Indiana, for DUI (fourth offense), DUI while suspended, and habitual offenders.
Judge Thomas Bianco will conduct Plea Court today for a several defendants, including a woman from Marstellar, Cambria County, in a 2017 counterfeiting case.
The charges were filed in October of 2018 by state police in Indiana. 46-year-old Beth Ann Jim is charged with 31 counts of possessing or accessing a device knowing it was counterfeit or altered. All of the offenses are third degree felonies.
Other Plea Court appearances before Judge Bianco today include:
- 35-year-old Danielle McGhen of Indiana, who is charged with theft and receiving stolen property.
- 27-year-odl Michael Kirk Wiles of Indiana, for two counts of DUI, driving while suspended with a blood-alcohol content over .02, and traffic violations.
- 41-year-old Virginia Jones of Blairsville, for possession of a controlled substance, possession of drug paraphernalia, disorderly conduct, and public drunkenness.
Judge Michael Clark will conduct Plea Court for two defendants:
- 63-year-old James Taglieri of Marion Center will plead to theft by deception or false impression.
- 30-year-old Andrew Mark Bimbo of Indiana will plead to defiant trespass and failure to notify police of a change in address.
